1. Acceptance of Terms

By creating an account, submitting content, or using any part of the RockHardChic platform ("Service"), you agree to these Terms of Service ("Terms"), our Privacy Policy, and our Community Guidelines. If you do not agree to these Terms, you may not use our Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility

Age Requirement: You must be at least 18 years old to submit content, create a profile, or upload videos to this Service. Users under 18 may browse public content but may not submit any materials or create accounts.

Age Verification Disclaimer: By submitting content or creating an account, you represent and warrant that you are at least 18 years old. RockHardChic relies on your truthful attestation of age and is not responsible for verifying the age of users beyond requiring this confirmation. You acknowledge that providing false information about your age is a violation of these Terms and may violate applicable laws.

Jurisdiction: By using the Service, you represent and warrant that you meet these eligibility requirements and that your use of the Service complies with all applicable local, state, national, and international laws and regulations.

3. Account Registration

Account Creation: You may need to create an account to access certain features. You agree to provide accurate, current, and complete information and to update this information to keep it accurate.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

Account Termination: We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. User Content & Submissions

Content Ownership: You retain all ownership rights to the content you submit to RockHardChic ("User Content"), including photographs, videos, biographical information, and portfolio materials.

License Grant: By submitting User Content, you grant RockHardChic a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and RockHardChic's business, including for promotional and marketing purposes.

Content Standards: You agree that your User Content will not:

• Contain nudity, explicit sexual content, or pornographic material
• Violate any third-party rights, including copyright, trademark, privacy, or publicity rights
• Contain hate speech, discriminatory content, or harassment
• Contain false, misleading, or fraudulent information
• Promote illegal activities or violate any applicable laws
• Contain viruses, malware, or any harmful code

Content Moderation: We reserve the right to review, remove, or refuse to display any User Content that violates these Terms or that we deem inappropriate for any reason.

Representations: You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit your User Content and grant the license described above, and that your User Content does not infringe any third-party rights.

Model and Property Releases: For any content featuring identifiable people or private property, you represent and warrant that you have obtained all necessary model releases, property releases, and permissions from all individuals and property owners depicted. You agree to provide such releases to RockHardChic upon request.

Age of Depicted Individuals: You represent and warrant that all individuals depicted in your User Content are at least 18 years old. You agree to maintain records proving the age of all depicted individuals and to provide such records to RockHardChic upon request.

4A. Video Submissions

Video Content Requirements: When submitting video content to RockHardChic, you agree to comply with all Terms and the following additional requirements:

• Third-Party Platform Links: Video submissions must be hosted on approved third-party platforms (YouTube, TikTok, or Instagram) and submitted via URL link only. RockHardChic does not host video files directly.
• Platform Terms Compliance: You acknowledge that you must comply with the terms of service of the platform hosting your video in addition to these Terms.
• Content Accessibility: You agree to maintain the video at the provided URL for the duration of your featured status on RockHardChic. If you remove the video from the hosting platform, RockHardChic may remove your feature.
• Age Verification for Video Submissions: By submitting a video, you explicitly confirm that you are at least 18 years old and that all individuals appearing in the video are at least 18 years old.
• Content Standards for Video: Video content must comply with RockHardChic's Community Guidelines and may not contain explicit nudity, sexual content, pornographic material, or any content prohibited by these Terms.

Editing Rights: You acknowledge and agree that RockHardChic may edit your submitted video for length, format, or clarity but will not edit in a manner that materially misrepresents your content or message.

Removal Rights: RockHardChic reserves the right to remove any video submission that violates these Terms, our Community Guidelines, or that we determine is inappropriate for any reason, without prior notice.

5. Paid Services & Subscriptions

Pricing: Certain features of the Service require payment of fees ("Paid Services"). All fees are in U.S. dollars and are non-refundable except as required by law or as explicitly stated in these Terms.

Billing: By purchasing Paid Services, you authorize us to charge your payment method on a recurring basis (monthly or annually) until you cancel your subscription.

Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will not receive a refund for any remaining time in your billing period.

Price Changes: We reserve the right to change our pricing with 30 days' notice. Continued use of Paid Services after a price change constitutes acceptance of the new pricing.

Free Trials: Free trial periods may be offered for Paid Services. We reserve the right to determine your eligibility for a free trial and to limit or revoke free trial access at any time.

6. Intellectual Property Rights

Platform Content: The Service and its original content (excluding User Content), features, and functionality are owned by RockHardChic and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks: RockHardChic, the RockHardChic logo, and other RockHardChic marks are trademarks of RockHardChic. You may not use these marks without our prior written permission.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

7. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use any automated system (bots, scrapers) to access the Service
• Collect or harvest any information from the Service without permission
• Engage in any form of harassment, bullying, or abusive behavior
• Use the Service to distribute spam or unsolicited communications
• Upload viruses or any malicious code
• Create multiple accounts to evade suspension or termination

8. Third-Party Links & Services

The Service may contain links to third-party websites or services that are not owned or controlled by RockHardChic. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that RockHardChic shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

9. Disclaimers

AS IS Basis: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee: RockHardChic does not guarantee that the Service will be uninterrupted, secure, or error-free. We do not guarantee any specific results from using the Service, including but not limited to bookings, job opportunities, or career advancement.

User Responsibility: You are solely responsible for your interactions with other users and third parties. We do not conduct background checks on users and make no representations about the conduct or suitability of any users or third parties.

User-Generated Content Disclaimer: RockHardChic is a platform that hosts user-generated content. We do not create, control, or endorse the content submitted by users, including videos, photos, and profile information. We are not responsible for the accuracy, legality, or appropriateness of user-submitted content. Any opinions, advice, statements, or other information expressed by users are those of the users themselves and not of RockHardChic.

Age Verification Disclaimer: While we require users to attest that they are at least 18 years old, we do not independently verify the age of users or individuals appearing in submitted content. We rely on users' representations and compliance with these Terms. We are not liable for any false representations made by users regarding age or any other matter.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROCKHARDCHIC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless RockHardChic and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

12. Dispute Resolution
